2.  DataFocus Embedded Nutcracker Software


The following license terms apply to the Embedded Nutcracker Software "Embedded Software") in 
addition to the terms of theBinary Code License:

a.  Each copy of the Embedded Software is licensed for internal use by the Licensee for the 
sole purpose of executing a single "Client Application" on a single computer.  "Client 
Application" is an application containing Embedded Software.  Each Embedded Software is in 
"use" on a computer when it is loaded into temporary memory (i.e. RAM) or installed into 
permanent memory (e.g. Hard disk, CD-ROM or other storage device) of that computer. However, 
installation on a server for the sole purpose of internal distribution shall not constitute 
"use" for which a separate license is required, provided you have a separate license for each 
computer to which the Embedded Software is distributed.  Licensee may archive copies of the 
Embedded Software for the sole purpose of backing up the Embedded Software and protecting their 
investment from loss but Licensee may not copy the printed materials accompanying the 
Embedded Software. This Embedded Software is protected by both United States copyright law 
and international treaties.  Therefore, Licensee must teat this Embedded Software like any 
other copyright material.

b. Licensee may not rent, lease, resell or distribute this Embedded Software to third parties, 
but Licensee may transfer Licensee's rights under this license on a  permanent basis provided 
that Licensee transfers the license, Embedded Software and all documentation and retains no 
copies, and the recipient agrees to the terms of this license agreement.  If the Embedded 
Software is an update or has been updated, any transfer must include the most recent update 
and all versions.  Notwithstanding the foregoing, Licensee shall not transfer Licensee's rights 
and obligations under this Agreement to any person or entity located in any country in which 
United States copyrights are not enforceable.  Any purported transfer contrary to these terms 
is null and void.

c. Licensee does not have the right under this agreement to use updated versions of the Embedded 
Software unless updates to the Embedded Software are purchased separately through an annual 
service or on a per update basis.

a.  The provisions of Sections 4 and 5 of the Binary Code License apply on behalf of Sun and its 
suppliers. 
b. Any provisions of the binary code license that differ from the license set forth at  
http://www.opengroup.org/openmotif/license apply on behalf of Sun only and not on behalf of its 
suppliers. 
c.  The source code for the Software is available from Sun upon request or through 
http://www.opengroup.org/openmotif

ACE(TM) and TAO(TM) are copyrighted by Douglas C. Schmidt and his research group at Washington 
University and University of California, Irvine, Copyright   1993-2001, all rights reserved. 
Since ACE and TAO are open-source, free software, you are free to use, modify, copy, and 
distribute--perpetually and irrevocably--the ACE and TAO source code and object code produced 
from the source, as well as copy and distribute modified versions of this software. However, you 
must include this copyright statement along with code built using ACE and TAO. 

In particular, you can use ACE and TAO in proprietary software and are under no obligation to 
redistribute any of your source code that is built using ACE and TAO. Note, however, that you may

The ACE and TAO web sites are maintained by the Center for Distributed Object Computing of 
Washington University for the development of open-source software as part of the open-source 
software community. By submitting comments, suggestions, code, code snippets, techniques 
(including that of usage), and algorithms, submitters acknowledge that they have the right 
to do so, that any such submissions are given freely and unreservedly, and that they waive
