Appendix E: License AgreementPlease read the following terms carefully. If you can't agree to them, you MUST NOT use Sharity. Definitions "Objective Development" stands for Heger, Schwarzott, Starkjohann & Tiefenbrunner OEG or Christian Starkjohann, whichever of the two companies has sold Sharity to you. (We are migrating business from the latter to the former, therefore any of the two may be your contract partner.) "You" is the person who receives a license and who is therefore our contract partner. "Sharity" refers to any file distributed within the Sharity Software's package. Individual files may have a different copyright, if explicitly noted in the file's header. Terms and conditions for using Sharity 1. Everyone may use Sharity in demo-mode. The demo-mode limits file access to the first three levels of directory hierarchy. It is also limited to only one installation in the network which can mount only one CIFS server. 2. You may use Sharity in full featured mode only if you are registered by Objective Development. Your proof for the registration is the registration key you receive from Objective Development. Each registration key contains a unique identifier which identifies its owner. 3. Licenses are issued with restrictions on the number of clients and servers that may simultaneously participate in Sharity-mounts. You must not exceed these limits, even if it is technically possible. 4. As an owner of a registration key you must keep the key secret. If other users are found who use your key, you are liable for the damage that arises to Objective Development. Sharity aids you in keeping the key secret: It is stored in encrypted format and it can not be retrieved through user interaction. 5. The conditions for obtaining a registration key are not part of this license. You can find them in the internet at the URL: http://www.obdev.at/Products/Sharity.html 6. Code reuse: You must not use parts or all of Sharity's code in any of your programs without written permission from Objective Development or Christian Starkjohann. Code reuse licenses are available on request. Please mail to sharity@obdev.at for details. Terms and conditions for distributing Sharity 7. You may copy and distribute Sharity and its documentation, provided that no modifications are made. Distribution on CD or by ftp servers in the internet are explicitly welcome. However, you must not distribute any license keys obtained for this program (see term 4). Terms and conditions for modifying Sharity 8. You may modify your copy of Sharity except for the limitations of the demo-mode and the supervision of the license limits. Under no circumstances are you allowed to change the 3 directory level limit of the unlicensed program or the supervision of the license limits! 9. If you want to distribute a modified version of Sharity, please get in contact with us at <sharity@obdev.at>. You must not distribute a modified version without written permission from Objective Development or Christian Starkjohann (see term 7). We consider a PGP signed e-mail as sufficient. Disclaimer CHRISTIAN STARKJOHANN AND OBJECTIVE DEVELOPMENT DISCLAIM ALL WARRANTIES WITH REGARD TO THIS SOFTWARE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS, IN NO EVENT SHALL CHRISTIAN STARKJOHANN OR OBJECTIVE DEVELOPMENT BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTUOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THIS SOFTWARE.
